Despite insurmountable odds Mr. Montoya was able to convince a federal magistrate to release his client on bail. The assistant United States attorney filed for detention without bail based on client’s extensive criminal history and the nature of the charges. Compounding the client’s release was that pre-trial services also recommended his detention without bail. Mr. Montoya successfully argued that his client was not a flight risk and would appear in court as he had done on numerous occassions and provided corroborating evidence to bolster his argument. Despite strenious objection from the United States, the court agreed with Mr. Montoya’s arguments, set bail and released client.
