Months of persistent determination led to Mr. Montoya persuading the district attorneys office to withdraw charges against his client despite aggressive police tactic and a cooperating witness who had identified his client as the culprit. Charges including F1 aggravated assault, kidnapping and other numerous charges were dismissed after Mr. Montoya’s alibi defense was substantiated by an FBI expert who analyzed phone records and determined his client was 15 minutes from the incident scene.
