Commonwealth v. M.C.

Frente a una pena de cárcel obligatoria MC fue acusado de posesión con intención de entregar más de 100 pastillas. Después de revisar los informes de la policía, específicamente la declaración jurada de causa probable para buscar en su auto y casa, Sr.. Montoya se dio cuenta de que la información utilizada por el oficial de policía le faltaba causa probable. Antes del juicio al Sr.. Montoya argumentó con éxito una moción para suprimir la que se concedió. Using his experience, Sr.. Montoya noticed that the police office failed to state when he received the information from the informer. Much more important Mr. Montoya also argued that the Court had to
apply the anonymous tip standard when it reviewed the four-corners. After hearing argument the Court agreed and found that the search warrant was unconstitutional and ruled that the search on M.C.’s car and house was illegal and suppressed the evidence against him. This motion was won because Mr. Montoya has extensive experience evaluating search warrants for lacking information.
