Commonwealth v. L.W. – Tag Team

LW was charged with burglary, criminal trespass, simple assault, terroristic threats, contempt and various related charges for breaking into his step-mother’s house and allegedly assaulting his estranged wife, a Philadelphia police officer. Mr. Montoya represented LW at the preliminary hearing and was able to get all felony charges dismissed for lack of evidence by soliciting that the door had been open and that LW was let in by his mother in law. At the trial stage Mr. Shaffer was able to finish the job by using the foundation Mr. Montoya had laid at the preliminary hearing. That foundation laid out a set of inconsistencies that led the judge to render a verdict of NOT GUILTY on all charges.
