J.C. was charged with the most heinous crimes of rape, involuntary deviate sexual intercourse, and other horrible offenses. The complainant who was 9 years old at the time testified that J.C. sexually assaulted her twice 4 years ago when they both lived at their grandmother’s home. During cross examination Mr. Montoya was able to illuminate various contradictions including the most telling, that she had told her brother it was a different cousin. Mr. Montoya also highlighted and dispelled a supposed prompt complaint by illuminating how no evidence was presented. After thoroughly highlighting the inconsistencies and argument, the court agreed with Mr. Montoya and found J.C. not guilty of all charges.
